3. User Responsibilities

The user agrees to the following responsibilities:

• To use the received SMS codes only for their own transactions and lawful account verification processes.
• Not to use the personal data, identity information, or contact details of others without authorization.

• To comply with the rules, membership terms, and usage policies of the relevant platforms.

4. Intellectual Property Rights

6. Payment and Billing

SMS verification services are provided on a prepaid basis. Users are required to load their account balance before benefiting from the services. The prices displayed on the site are current prices and may be changed automatically without prior notice in accordance with exchange rate fluctuations.

7. Limitation of Liability

Onay360 shall not be held liable for any damages arising from the use of its SMS verification services, except in cases involving its own intent or gross negligence. In particular, no liability is accepted in the following cases:

Operator and Infrastructure-Related Issues

Delays, non-delivery, or connection problems caused by SMS operators or technical infrastructure.

Third-Party Platform-Related Issues

The relevant platforms not accepting SMS codes, rejecting the verification process, or deeming the transaction invalid under their own rules.

User-Related Issues

Damages arising from the user’s incorrect selection, use of the wrong service, incorrect execution of transactions, or actions contrary to the terms of use.

Force Majeure

Service disruptions caused by force majeure events such as natural disasters, war, cyberattacks, infrastructure collapse, or electricity or internet outages.

Except in cases of intent or gross negligence, Onay360’s total liability under these Terms of Service is, in all cases, limited to a refund of the amount the user paid for, or loaded onto their account for, the relevant transaction. This limitation applies to all situations, including those arising from third-party API/infrastructure providers, telecom operators, or unauthorized access (cyberattacks).

8. Account Suspension and Termination

Onay360 reserves the right to suspend, restrict access to, or permanently terminate the accounts of users who violate the terms of use, are suspected of engaging in illegal activities, violate the rules of third-party platforms, or misuse the services, without prior notice.

9. Privacy and Data Protection

User data is processed and protected within the framework of applicable legislation, the KVKK, and the Privacy and Personal Data Protection Policy published on the site. Information obtained within the scope of the service may be retained for purposes of security, service continuity, legal obligations, and record-keeping of transactions.

10. Dispute Resolution

The laws of the Republic of Türkiye shall apply to any disputes arising from these terms of use. The parties shall first seek to resolve disputes in good faith. For unresolved disputes, within the monetary limits announced annually by the Ministry of Trade, the Provincial/District Consumer Arbitration Committees at the consumer’s place of residence have jurisdiction; for disputes exceeding those limits, the Consumer Courts and the generally competent courts and enforcement offices of Türkiye have jurisdiction.

11. Changes to the Terms

Onay360 reserves the right to amend these terms of use. Updated terms shall become effective as of the date they are published on the site. If material changes are made to the detriment of the user, such changes may be separately announced on the site; the user’s continued use of the service means acceptance of the current terms.
