Membership Agreement

Please read this text carefully before using this website (https://onay360.com), hereinafter referred to as the “SITE”. Anyone who visits the SITE, becomes a member, or uses the services declares that they have read, understood, and accepted this Membership Agreement, the Terms of Use, and the KVKK and Privacy Policy.

Terms of Use

The SMS verification services offered on this SITE (hereinafter referred to as “Onay360”) are provided by Onay360. The terms may be updated periodically; updates take effect on the date they are published on the SITE. The scope of the services, access requirements, and manner in which they are provided are determined by Onay360.

Definitions

Site

The website operating under the domain https://onay360.com.

Member

A natural person whose account is approved after completing the membership form and who purchases a service.

User

A person who visits the SITE and/or uses the services.

Service

A digital service that facilitates the delivery of one-time SMS verification codes.

Membership Requirements

To become a member of the SITE and use the services, the user must be at least 18 years old and have legal capacity. Persons under the age of 18 or without legal capacity may not become members of the SITE or carry out transactions requiring payment. If this requirement is breached, Onay360 reserves the right to suspend or terminate the relevant account.

Scope of Services

The Service facilitates the delivery of one-time SMS verification codes; no physical delivery is involved. Delivery of the codes depends on third-party factors such as telecommunications operators, technical infrastructure conditions, and the practices and rules of the relevant platforms. Onay360 reserves the right to modify, temporarily suspend, or terminate the Service when it considers this necessary.

Payment and Refund Terms

Payments are collected in advance. The refund conditions and refund method are set out in the Refund Policy. No refund is issued after the code has been delivered and/or the verification process has been completed on the relevant platform. Mandatory provisions arising from applicable law remain reserved.

General Provisions

The SITE and services may be used only for lawful purposes. Use for purposes that violate the law or the rules of the relevant platforms, including spam, fraud, identity theft, deceptive activities, unauthorised access, and the creation of fake accounts, is strictly prohibited. Links to third-party websites are provided for information only; Onay360 is not responsible for the content, security, or services of those websites. Intellectual property rights in the SITE’s content, design, software, and all its components belong to Onay360; they may not be copied, reproduced, distributed, or adapted without permission.

Limitation of Liability

The Service is not guaranteed to be uninterrupted or error-free. Except in cases of intent or gross negligence on the part of Onay360, Onay360 cannot be held liable for losses arising from operator-related delays, rejection of a code by third-party platforms, user error, system congestion, force majeure, or similar circumstances. Except in cases of intent or gross negligence, Onay360’s total liability under this Agreement is in all cases limited to refunding the amount paid by the Member for the relevant transaction or loaded into their account for that transaction. The User accepts that they are responsible for all legal and criminal consequences arising from their use of the SITE and services.

Assignment of the Agreement

Onay360 may assign this Agreement in whole or in part. The User or Member may not assign this Agreement.

Force Majeure

In circumstances legally recognised as force majeure, the parties’ performance obligations may be temporarily suspended; Onay360 cannot be held liable for delay or failure to perform.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye. For disputes within the monetary limits announced annually by the Ministry of Trade, the Provincial or District Consumer Arbitration Committees at the consumer’s place of residence have jurisdiction. For disputes exceeding those limits, the Consumer Courts and the generally competent courts and enforcement offices of Türkiye have jurisdiction.

Entry into Force and Acceptance

This Agreement enters into force on the date it is published on the SITE. If material changes are made to the detriment of the User, those changes may be announced separately on the site; a User who continues to use the SITE is deemed to have accepted the current terms.
