Distance Sales Agreement
Last updated: September 21, 2026
This Distance Sales Agreement and Preliminary Information Form (“Agreement”) is prepared in accordance with Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts. Every user purchasing a service via https://onay360.com (the “SITE”) confirms, before completing payment, that they have read and accepted this Agreement.
1. Parties
Seller
Trade name: Onay360
Website: https://onay360.com
Email: info@onay360.com
Buyer
The natural person who creates an account or makes a payment to purchase a service via the SITE (“User” or “Buyer”).
2. Subject of the Agreement
This Agreement governs the rights and obligations of the parties, under Law No. 6502 and the Regulation on Distance Contracts, regarding the sale and performance of the digital service (“Service”) ordered electronically by the Buyer via the SITE, which intermediates the delivery of single-use SMS verification codes.
3. Key Characteristics and Price of the Service
The type, scope, and current sale price (VAT included) of the purchased Service are clearly displayed to the Buyer at the order/payment step on the SITE and confirmed by the Buyer. The Service is not a physical good but a digital service performed instantly in electronic form; there is no shipping or physical delivery involved.
4. Payment Method
Payments are collected in advance, at the time of order, through the payment methods offered on the SITE (bank/credit card and other active payment tools on the SITE). Once payment is confirmed, the service fee is credited as balance to the Buyer’s SITE account, from which the Service is deducted.
5. Performance and Delivery
The Service is performed instantly in electronic form as soon as the Buyer initiates the transaction on the SITE. Performance of the Service may vary depending on factors outside the SITE’s direct control, such as telecom operators, technical infrastructure, and the rules of relevant third-party platforms.
6. Right of Withdrawal and Its Exception
Under Article 15(1)(ğ) of the Regulation on Distance Contracts, “contracts for services performed instantly in electronic form or intangible goods delivered instantly to the consumer” are among the contracts for which the right of withdrawal cannot be exercised. Since the SMS verification Service offered via the SITE is performed instantly in electronic form at the time of order, the Buyer’s right of withdrawal is extinguished upon confirmation of the transaction. Refund conditions applicable to exceptional cases, such as the Service not being provided at all, are separately set out in the Refund Policy.
7. General Provisions
By confirming the order, the Buyer acknowledges having learned the key characteristics of the Service, its sale price, the payment method, and the exception to the right of withdrawal, and confirms this electronically. The provisions of this Agreement apply together with the Membership Agreement and Terms of Use published on the SITE; in case of conflict, the payment and withdrawal provisions of this Agreement prevail.
8. Dispute Resolution
Disputes arising from this Agreement are subject to the jurisdiction of the Provincial/District Consumer Arbitration Committees and Consumer Courts at the Buyer’s place of residence, within the monetary limits announced annually by the Ministry of Trade.
9. Effectiveness
By placing an order via the SITE, the Buyer is deemed to have electronically accepted all provisions of this Agreement. Onay360 reserves the right to update this Agreement without prior notice; the updated agreement takes effect as of its publication date on the site.
